4.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payment is processed through secure third-party payment providers
• You authorize us to charge your payment method for recurring subscription fees

4.3 Cancellation & Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• We offer a 7-day money-back guarantee for new subscribers
• No refunds are provided for partial months or unused features

5 Your Content

5.1 Content Ownership

You retain all rights to the content you upload, including photos, videos, journal entries, and other materials ("Your Content"). We do not claim ownership of Your Content.

By uploading content to the Service, you grant us a limited, non-exclusive, royalty-free license to store, display, and process Your Content solely for the purpose of providing the Service to you. This license terminates when you delete Your Content or your account.

You are solely responsible for Your Content and represent that:

• You have the right to upload and share the content
• You have consent from any individuals depicted (or are their legal guardian)
• The content does not violate any laws or third-party rights

6 AI Story Generation Services

6.1 Service Description

Our AI-powered story generation feature creates personalized stories based on Your Content. The AI analyzes your photos, journal entries, and milestones to generate narrative stories.

6.2 AI Limitations

• AI-generated stories are for entertainment and personal use
• We do not guarantee the accuracy or appropriateness of AI-generated content
• You should review all AI-generated content before sharing

6.3 AI Data Usage

Your Content used for AI story generation is processed securely and is not used to train AI models for other users. See our Privacy Policy for details.

7 Acceptable Use

You agree not to use the Service to:

• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Upload content depicting child exploitation or abuse
• Impersonate others or misrepresent your affiliation with a person or entity
• Interfere with or disrupt the Service or its servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems to access the Service without our permission
• Violate any applicable laws or regulations

8 Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are owned by Baby's Storybook AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code.

9 Termination

9.1 Your Right to Terminate

You may delete your account at any time through the app settings. Upon deletion, we will remove Your Content according to our data retention policy.

9.2 Our Right to Terminate

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or the Service
• Is fraudulent or illegal

9.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions that should survive termination will remain in effect.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We are not responsible for:

• Loss of data due to circumstances beyond our control
• Content or conduct of third parties on or through the Service
• Accuracy of AI-generated content

11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BABY'S STORYBOOK AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12 Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

12.2 Dispute Process

• Arbitration: Any disputes not resolved informally shall be resolved through binding arbitration.
• Class Action Waiver: You agree to resolve disputes individually and not as part of a class action.

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the app or by email at least 30 days before they take effect. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
